TERMS AND CONDITIONS
These Terms govern your use of this website and your engagement with Dominic Loneragan Photography for photography and related creative services. By using this site or enquiring about services, you agree to these Terms.
The full commercial agreement for any booking — including rates, licensing tiers, and project-specific terms — is provided privately with your quote as the Services Agreement. Where the signed Services Agreement and these website Terms differ, the Services Agreement prevails for that engagement.
1. About us
Dominic Loneragan Photography is the trading name of Citizens of the World Pty Ltd, an Australian company based on the Gold Coast, Queensland, with studio operations across the Gold Coast and Sydney. We provide photography, video, and creative content services to commercial clients across architecture, venue and food, e-commerce, portrait, and events.
2. Website use
The content on this website — including photographs, copy, design, and layout — is owned by Dominic Loneragan Photography or its licensors and is protected by Australian and international copyright law. You may browse the site for personal and non-commercial reference. You may not download, copy, reproduce, or republish any content from this site without our prior written consent.
3. Enquiries and bookings
Submitting an enquiry through this website does not create a binding agreement. A booking is only confirmed once:
A written quote and Services Agreement has been issued by us;
You have accepted the quote in writing; and
The required deposit has been received.
Until all three conditions are met, we reserve the right to decline, defer, or modify any engagement.
4. Copyright on commissioned work
We retain full copyright in all photographs, video, and creative work we produce, unless the Services Agreement for that engagement expressly transfers copyright to you.
On full payment of the agreed fees, you receive a licence to use the delivered content on the terms set out in your Services Agreement. As a baseline, we grant perpetual worldwide rights for your own owned channels — your website, social media, email marketing, in-venue display, and internal business collateral. Additional usage for editorial press, paid advertising, out-of-home placements, or full buyout is available as a separate paid licence, as specified in your Services Agreement.
We assert our moral rights as creator and expect to be credited when our work is published.
5. Attribution
Where content is published — on social media, websites, editorial placements, or print collateral — we ask that you credit Dominic Loneragan Photography. Specific attribution requirements, including our official handles and tagging standards, are set out in your Services Agreement.
6. Confidentiality
We treat client information, briefs, and project details confidentially. In return, we ask clients to treat the commercial terms of their engagement — including fees, discounts, licensing costs, and any negotiated variations — as confidential. Full confidentiality obligations are set out in the Services Agreement.
7. Payment, cancellation, and delivery
Payment, deposit, cancellation, rescheduling, delivery timeframes, and revision allowances are governed by the Services Agreement provided with your quote. As a general guide:
A deposit is required to secure any booking.
Final payment is due before delivery of final files.
Cancellations within a short window of the scheduled shoot may result in forfeiture of the deposit and additional fees.
Delivery timeframes vary by project scope and are specified per engagement.
8. Model and property releases
You are responsible for obtaining all model and property releases necessary for the intended use of the content we deliver. We are not liable for claims arising from your failure to secure appropriate releases.
9. Insurance and liability
We maintain Public Liability and Professional Indemnity insurance covering our operations. To the maximum extent permitted by Australian law, our liability for any claim arising from an engagement is limited to the fees paid for that engagement. Nothing in these Terms excludes any consumer guarantees under the Australian Consumer Law that cannot lawfully be excluded.
10. Privacy
We handle personal information in accordance with our Privacy Policy. Client data is not shared with third parties except where required by law or necessary to deliver our services.
11. Portfolio and promotional use
Unless you request otherwise in writing before the engagement begins, we reserve the right to feature our work for you in our portfolio, on this website, on social media, and in marketing materials.
12. Changes to these Terms
We may update these Terms from time to time. The current version, together with its effective date, is always available at this URL. Material changes do not affect the terms of Services Agreements already signed before the change.
13. Governing law
These Terms are governed by the laws of Queensland, Australia. Any dispute arising in connection with these Terms or any engagement is subject to the exclusive jurisdiction of the courts of Queensland.
